Information obligation – processing of data for the purpose of concluded contracts (personal data of contact persons and representatives)

Rule of law Articles 13 and 14 of the general Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC hereafter referred to as RODO.
Data controller The administrator of your personal data is NETWORK EXPERTS spółka z ograniczoną odpowiedzialnością spółka komandytowa with its registered office in Warsaw (03-583), ul. Chojnowska 8, entered in the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw in Warsaw, XIII Economic Division of the National Court Register under the KRS number 0000639343, NIP 5242751391, Regon 146116650.
Data Protection Officer The controller has appointed a Data Protection Officer whom any individual can contact for details of the processing of their personal data. The Data Protection Officer may be contacted by traditional means (at the physical address of the controller), or by e-mail: krystian.erens@infomania.pl. The Data Protection Officer is Mr Krystian Erens.
Purpose and basis of processing of personal data We will process your personal data in order to:

– concluding or performing a contract – the legal basis for the processing of your personal data is, in the case of a representative person and a contact person on behalf of the contractor, the necessity of the processing of the data for the performance of the contract in accordance with Article 6(1)(b) RODO as well as the legitimate interest of the controller in accordance with Article 6(1)(f) RODO. The legitimate interest is to be able to conclude and perform contracts with entities represented by natural persons, to be able to verify the entitlement to represent the counterparty and to be able to contact the persons indicated by the counterparty for contact in connection with the performance of contracts;

– the defence against claims or the assertion of claims related to the concluded contract – the legal basis for the processing of personal data is the necessity of the processing for the realisation of the controller’s legitimate interest in accordance with Article 6(1)(f) RODO. The legitimate interest of the controller is the possibility to defend against claims or to assert claims;

– fulfilment of the controller’s legal obligations relating to accounting and taxation in accordance with Article 6(1)(c) RODO – the legal basis for the processing of personal data is the necessity of the processing to fulfil the controller’s legal obligation;

– to deal with requests and demands (where such are made) – the legal basis for processing personal data is the necessity of the processing to pursue the legitimate interest of the controller pursuant to Article 6(1)(f) RODO. The legitimate interest of the controller is to receive and handle the process of requests and demands made and to respond to them. In the case of requests directly related to the exercise of the rights of persons referred to in the RODO – the legal basis for the processing of personal data is a legal provision;

– archives – the legal basis for processing personal data is the necessity of the processing for the realisation of the legitimate interest of the controller pursuant to Article 6(1)(f) of the RODO. The legitimate interest of the controller is to be able to secure information in case of a legal need to prove facts related to the provision of a service or the compliance of the controller with the law.

Period of data processing Your personal data will be processed:

– for the duration of the contract and after its termination, until the statute of limitations for claims under the contract concluded between the contractors, for the purposes of performing the contract, dealing with complaints, defending against claims or asserting claims;

– until the expiry of the obligation to store data resulting from the provisions of law, in particular the obligation to store accounting (bookkeeping) documents relating to the contract – for the purposes of fulfilling obligations resulting from the provisions of law;

In the case of data processing on the basis of the legitimate interest of the controller, the individuals whose processing is carried out are entitled to object to the processing of personal data on the basis of the legitimate interest of the controller. The controller will then cease to process the indicated personal data to a certain extent, unless the controller can demonstrate that there are valid legitimate grounds for the controller to process the data which override the interests, rights and freedoms of the individuals, or the data are necessary for the possible establishment, investigation or defence of claims.

Recipients of data Access to your personal data, is available to our employees and associates who are authorised to process personal data. In addition, in certain situations we may transfer your data, e.g. in order to comply with a legal obligation or to exercise a legitimate interest pursued by the controller or by a third party. The categories of recipients to whom we may disclose your personal data are entities or authorities authorised by law, as well as service providers processing the entrusted personal data on behalf of the controller on the basis of personal data processing entrustment agreements or other agreements pursuant to the provisions of applicable law.
Rights and entitlements

 

You have the right to request from the controller access to your personal data, rectification, erasure or restriction of processing, to object to the processing of your data. At any time, in the event that you consider that our processing of your personal data violates your rights – you also have the right to lodge a complaint to the supervisory authority, which is the President of the Office for Personal Data Protection with its registered office at 2 Stawki Street, 00-193 Warsaw.
Źródła oraz zakres pozyskiwanych danych osobowych The data controller obtains personal data directly from the contractor as a party to the contract. The categories of data obtained by the data controller may include: identification data (e.g. name, surname, company name, VAT number and company address), as well as contact data of the natural persons appointed to handle/execute the contract (e.g. telephone number, e-mail address, job details).
Additional information The provision or transfer of personal data by the contracting party is voluntary, but necessary for the conclusion or performance of the contract. Without the provision of personal data of the person representing the contracting party – the conclusion or execution of the contract is impossible. In the case of information about the persons indicated to contact on behalf of the counterparty – failure to provide data may hinder the performance of the contract and, in certain cases, may result in the impossibility of performing the contract.
Obligation under Article 14. of the RODO On behalf of the data controller, this notice should be provided to all data subjects.
